At 2525 we carefully select our Legal Support from a small number of long-established firms. All legal work is undertaken by legally qualified personnel. To enable us to get the most out of our Legal Support, business is usually conducted with our solicitors by face to face meetings at our offices. This enables us to carefully manage the time spent on your case but at the same time develop a cohesive strategy to either defend or settle the claim.

Where input from a barrister is required, case conferences can, where appropriate, also be conducted at our offices or a location convenient to our policyholders.

Efficiency and results

Our innovative approach avoids long-distance correspondence and dialogue with our appointed solicitors, which is time-consuming and can incur significant expense.

With Legal Support located in our office, we make sure everyone’s time is spent as efficiently as possible, reducing the need for additional report writing or unnecessary correspondence.

Principle before profit

During the process, it is important that our policyholders’ commercial imperatives and strategic objectives are also taken into account. We recognise that there may be a point of principle at stake. Therefore, we may agree to support a policyholder in pursuing a defence to a claim even when a merit-based, technical legal analysis suggests that the claim may succeed at Court.

Putting principle before profit, we are able to bring a sense of balance to the way such issues are approached. This also avoids the outcome where claims are routinely paid without consultation with the policyholder, simply to achieve an early, low-cost settlement with minimal risk

HSE prosecutions

Unlike many other insurers, we use specialist regulatory solicitors to provide Legal Support to assist you in resolving any issues you might have with the Health & Safety Executive, Police or Environment Agency arising in connection with a claim under the policy. The levels of fines and penalties for companies and their directors following a successful prosecution have never been higher. We believe it is vital that you receive specialist Legal Support and are adequately covered for associated defence costs. Our specialist team of regulatory solicitors are immediately on hand to provide advice and reassurance when it really matters.

Standard Policy Legal Support and Costs Protection

Our Employers' Liability and Public, Products and Pollution Liability cover includes:

• Defending any Proceedings relating to a claim

• Issuing Proceedings for contribution or recovery

• Negotiating compromise settlement

• Representation at a coroner’s inquest or fatal accident enquiry

• Representation at a Police and Criminal Evidence (PACE) interview

• Defending corporate manslaughter charges

• Defending prosecution for breach of Part 1 of the Health & Safety at Work Act

• Defending prosecution for breach of Construction (Design and Management) Regulations

Note: Certain defence costs can only be expended with the Syndicate’s prior written consent. Defence costs are payable in addition to the Limit of Indemnity on Public Liability policies. Please see your Policy document for the full terms and conditions of the cover available.
